Terms of Sale

These Terms of Sale apply to reports purchased through the English pages of Melmaga Zukan (https://melmaga-zukan.com/en/), operated by SweetLeap Inc. ("we", "us"). Please read them before you order.

1. Business customers only

1. Our English reports are sold to businesses only. By placing an order, you confirm that you are buying on behalf of a business and that you have authority to accept these terms for it.
2. The English reports are intended for customers located outside Japan. If your business is located in Japan, please buy through our Japanese pages.

2. Orders and payment

1. Prices are shown in US dollars on each product page and on the order summary.
2. Payment is taken once, by card, through our payment processor Stripe when you place the order. There is no subscription.
3. A contract is formed when your payment is completed.
4. We do not add Japanese consumption tax to sales to business customers located outside Japan. You are responsible for any VAT, GST, sales tax or similar tax you owe under the rules where you are located. If we learn that your business is located in Japan, we may contact you about applicable Japanese tax.

3. Delivery

1. Delivery times are stated on each product page and on the order summary. Brand and industry reports are delivered within 5 business days in Japan (excluding weekends and Japanese public holidays).
2. We deliver by emailing you a download link. The link is valid for 30 days; please save the files. If the link expires, reply to our email and we will send a new one.

4. Cancellation and refunds

1. You may cancel an order for a full refund by emailing us before the report is delivered (for pre-orders, by the date stated on the product page).
2. If we deliver late, or a pre-ordered report does not meet the coverage stated on its product page, we refund you in full on request.
3. Because reports are digital content, we do not offer refunds after delivery, except where these terms or applicable law require otherwise.

5. How you may use a report

1. You may use a report for the internal business purposes of your company, including its employees.
2. You may quote parts of a report in your internal documents and proposals to your clients, with attribution to Melmaga Zukan.
3. You may not resell, publish, or distribute a report in whole or in substantial part, or use it to disparage a brand or person.

6. About the data

1. Reports contain figures that we read automatically from the marketing emails received by our inboxes in Japan. They describe what a new subscriber receives, not a brand's entire email program, and may contain errors. We correct errors when we become aware of them.
2. Reports contain aggregated figures only. They do not reproduce the text or images of the emails, which remain the property of each brand.
3. We are not affiliated with the brands covered in our reports.

7. Liability

1. We provide reports with reasonable care but do not guarantee any particular business result from using them.
2. Except in cases of our willful misconduct or gross negligence, our total liability arising from a report is limited to the amount you paid for that report.

8. Governing law and jurisdiction

These terms are governed by the laws of Japan. The Osaka District Court has exclusive jurisdiction in the first instance over any dispute arising from them.

9. Changes and contact
